After the Financial Institutions Act, which came into force on January 1, 2020, granted portfolio managers and trustees that had not previously been subject to prudential supervision a grace period until December 31, 2022 to submit their license applications to FINMA, the last client of Koller Law to adapt to the new law is expected to receive FINMA approval in the next few days.
In total, we have assisted 51 portfolio managers and trustees as well as managers of collective assets in the FINMA-licensing process and, in the case of those already licensed, in adapting their internal structures and frameworks. Three applications were withdrawn by the clients. No application was rejected.
This demonstrates Koller Law's Swiss-wide exceptional experience in FINMA licensing processes, during which we have gained deep insight into the organization and business models of our clients and have been able to provide our input on often challenging regulatory and private law issues as well as on judgment calls.
